Membership Terms & Conditions

Effective date: 11th March 2026

1. Introduction

These Terms & Conditions govern your access to and use of The Food Allergy Baby Circle™ (“the Membership”), operated by Nishti’s Choice Ltd (“we”, “us”, or “our”).

By purchasing and accessing the Membership, you confirm that you have read, understood, and agreed to these Terms.

These Terms operate alongside your statutory rights under applicable consumer law. Where you are located outside the United Kingdom, your local mandatory consumer protection laws may apply in addition to, or instead of, certain provisions of these Terms. Nothing in these Terms is intended to, or shall, limit any rights you have under mandatory laws applicable in your country of residence.

For UK members, these Terms operate alongside the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

2. Eligibility

To purchase and access the Membership, you must:

  • Be at least 18 years of age
  • Have the legal capacity to enter into a binding contract in your country of residence
  • Agree to these Terms in full before completing your purchase

The Membership is open to parents and carers worldwide. By purchasing, you confirm that you meet the eligibility requirements above.

3. About The Membership

The Food Allergy Baby Circle™ is a dietitian-led membership designed to support parents and carers navigating food allergies in babies and young children, wherever they are in the world.

The Membership provides:

  • Expert-led guidance from specialist paediatric dietitians
  • Support with food allergies including cow’s milk allergy and multiple allergens
  • Education on feeding, starting solids, and allergen reintroduction
  • Ongoing access to resources and a global parent community

The Membership is designed to provide education, guidance, and support. It does not replace individual medical care or personalised dietetic advice. Members are responsible for seeking appropriate local healthcare for their child.

4. Membership Features

Your Membership may include the following features:

4.1 Live Workshops & Teaching Sessions

  • Regular live sessions led by specialist paediatric dietitians
  • Covering allergy management, feeding, and nutrition
  • Typically recorded and made available for later access (not guaranteed) — so international members in different time zones can access sessions at a convenient time

4.2 Live Q&A Support

  • Group Q&A sessions for general guidance
  • Not a substitute for personalised clinical advice

4.3 Resource Library

Access to a comprehensive library which may include:

  • “Starting your allergy baby on solids” course
  • Food ladders (e.g. milk, egg, wheat, soya)
  • Nutrition guidance and feeding support tools

Content may be updated, changed, or removed at any time. Resources reflect UK clinical guidelines and practice. International members should note that local clinical guidelines or formula availability may differ.

4.4 Community & AI Support

The Membership includes access to:

  • A private community space for peer support, where our team contributes regularly
  • Nishti AI — an AI tool trained by Nishti, available around the clock for general allergy and feeding guidance

Please note: Nishti AI provides general educational information only and does not constitute clinical advice. Dietitian responses within the community are provided on a best-efforts basis during UK working hours and are not guaranteed at all times. The community is not monitored 24 hours a day.

Any guidance received through the community or AI tool does not replace a formal clinical assessment or personalised dietetic advice.

5. User Responsibilities

By joining the Membership, you agree to:

  • Engage respectfully with other members and staff
  • Not post harmful, offensive, misleading, or medically irresponsible content
  • Respect the privacy and confidentiality of other members
  • Not share, reproduce, or distribute any Membership content outside the platform

We reserve the right to remove access without notice or refund if these standards are not upheld.

6. Medical Disclaimer

All content within the Membership is provided for educational purposes only. It:

  • Does not constitute medical or clinical dietetic advice
  • Is not tailored to your individual child’s needs
  • Does not replace consultation with a qualified healthcare professional
  • Reflects UK clinical guidelines, which may differ from guidelines in your country of residence

You are responsible for how you use the information provided. Always consult your local GP, paediatrician, or a registered dietitian for individual clinical advice. In a medical emergency, contact your local emergency services immediately.

7. Access & Delivery

The Membership is delivered entirely online and is accessible worldwide, subject to availability of internet access. We aim to deliver all features as described; however:

  • Session times are scheduled in UK time (GMT/BST) and may not be convenient for all time zones — recordings are provided where possible
  • Content may be updated or removed
  • Technical issues may occasionally affect access

We do not guarantee uninterrupted availability of the platform or any specific feature.

8. Communication & Support

Support is primarily provided within the Membership environment. Additional support is available as follows:

  • Email support: info@nishtischoice.com, available Monday–Friday, 9am–5pm UK time
  • Responses typically within 2 business days (not guaranteed)

9. Payment Terms

9.1 Taster Plan

The Taster Plan is structured as follows:

  • ÂŁ197 upfront payment, covering the first 3 months of access
  • After the initial 3 months, membership automatically continues at ÂŁ57 per month, billed monthly
  • The monthly continuation is subject to the cancellation terms in Section 10.1

9.2 Foundations Plan (Annual)

  • ÂŁ647 upfront payment
  • 12 months’ access from the date of purchase
  • Does not automatically renew

By purchasing, you agree to the applicable payment structure for your chosen plan.

9.3 Currency & Taxes

All prices are displayed and charged in Pound Sterling (GBP ÂŁ). If you are purchasing from outside the United Kingdom, your bank or payment provider may apply currency conversion fees or charges. These are outside our control and are your responsibility.

Prices shown are inclusive of any applicable UK VAT. International members may be subject to local taxes, duties, or levies in their country of residence. We are not responsible for any such local tax obligations, and it is your responsibility to comply with local tax laws.

9.4 Failed Payments

If a payment fails, we will notify you and attempt to collect the outstanding amount. You are responsible for ensuring your payment details are kept up to date. If payment is not received within 7 days of the due date, we reserve the right to suspend access to the Membership until the outstanding amount is settled. Suspension does not cancel your Membership or reduce any amounts owed.

9.5 Outstanding Payments & Debt Recovery

Any unpaid amounts owed to Nishti’s Choice Ltd remain a legal debt. We reserve the right to pursue outstanding balances through appropriate legal or debt recovery channels. You may also be responsible for any reasonable costs incurred in recovering unpaid amounts.

10. Cancellation

10.1 Taster Plan

The initial ÂŁ197 payment covers your first 3 months of access. This payment is non-refundable except as set out in Sections 11 and 11A.

After your initial 3 months, your membership automatically continues on a rolling monthly basis at ÂŁ57 per month. By purchasing the Taster Plan, you agree that:

  • Monthly billing will begin automatically after your 3-month period ends
  • You will be notified before monthly billing begins

Once monthly billing has begun, you may cancel at any time:

  • By emailing info@nishtischoice.com or via your account settings
  • Cancellation stops future monthly payments
  • Access continues until the end of your current monthly billing period

If a monthly payment fails, we will notify you. If payment is not received within 7 days, we reserve the right to suspend access. Failure to pay does not constitute cancellation, and outstanding amounts remain a legal debt payable in full.

10.2 Foundations Plan (Annual)

Provides access for 12 months from the date of purchase. This plan does not auto-renew. The Foundations Plan is non-refundable except within the 7-day Peace of Mind Guarantee period (Section 11A) or the statutory cooling-off period (Section 11), whichever provides greater protection.

11. Statutory Cooling-Off Period

UK members have the right to cancel within 14 days of purchase without giving a reason, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. Members in other countries may have equivalent rights under their local consumer protection laws.

However, by completing your purchase, you acknowledge and agree that:

  • You will receive immediate access to digital content upon purchase
  • You expressly consent to this access beginning immediately
  • You understand that by beginning to access digital content, you may lose your right to a full refund under the statutory cooling-off period

If you have accessed content and request a refund within 14 days, a reasonable deduction will be made for any content accessed, including resources, live or recorded sessions, community access, and AI tool usage.

After 14 days from the date of purchase, no refunds will be provided under this section. Please see Section 11A for our separate Peace of Mind Guarantee.

11A. The 7-Day Peace of Mind Guarantee

We want you to feel completely confident joining The Food Allergy Baby Circle™, wherever you are in the world.

If, within 7 days of your purchase date, you feel the Membership is not right for you, simply email us at info@nishtischoice.com and we will issue a full refund — no questions asked.

This guarantee applies to both the Taster Plan and the Foundations (annual) Plan. For the Taster Plan, the guarantee applies to the £197 upfront payment only. Refunds under this guarantee will be processed within 5–10 business days to your original payment method.

After 7 days, our standard refund policy in Section 11 applies. This guarantee is a voluntary commitment by Nishti’s Choice Ltd and does not affect your statutory rights.

12. Privacy, Data Protection & GDPR

Your personal data is processed in accordance with our Privacy Policy, available at www.nishtischoice.com. We are committed to protecting your personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

Where you are located in the European Union or European Economic Area, we also comply with the EU General Data Protection Regulation (EU GDPR) in respect of your personal data. In such cases:

  • Your data is transferred to and processed in the United Kingdom, which the European Commission has recognised as providing an adequate level of data protection
  • You retain all rights afforded to you under EU GDPR, including the right to access, rectify, erase, or restrict processing of your personal data

For members located outside the UK and EU, your data may be transferred internationally. We take appropriate steps to ensure your data is protected in accordance with applicable law.

By joining the Membership, you agree:

  • Not to share confidential information disclosed within the Membership community
  • To respect the privacy of other members at all times

Any breach of these obligations may result in immediate removal from the Membership without refund.

13. Intellectual Property

All content within the Membership remains the sole property of Nishti’s Choice Ltd. You may:

  • Use materials for your own personal, non-commercial use only

You may not:

  • Copy, reproduce, distribute, or share content with any third party
  • Use materials for any commercial purpose

14. Termination

We reserve the right to suspend or terminate your access if:

  • You breach any of these Terms
  • Your behaviour is deemed inappropriate, harmful, or disruptive to other members
  • Payment is not received and remains outstanding after reasonable notice

No refund will be provided in cases of termination for breach of these Terms.

15. Changes to the Membership

We may update:

  • Membership content, resources, and features
  • Delivery structure and session scheduling
  • These Terms & Conditions

Where changes are material, we will notify you with reasonable notice. Continued use of the Membership after notification constitutes acceptance of the updated Terms.

16. Liability

To the fullest extent permitted by applicable law:

  • We are not liable for any loss or damage arising from your use of, or reliance on, content within the Membership
  • We do not guarantee specific results or outcomes for your child’s health

Nothing in these Terms excludes or limits liability where it is unlawful to do so, including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation. Members located outside the UK may have additional protections under their local law which are not affected by these Terms.

17. Complaints

If you have a complaint about the Membership, please contact us in writing in the first instance:

  • Please include “Complaint” in the subject line and provide as much detail as possible

We will acknowledge your complaint within 3 business days and aim to resolve it within 14 business days. If we are unable to resolve your complaint to your satisfaction, you may have the right to refer the matter to a relevant dispute resolution body or regulator in your country of residence.

18. Alternative Dispute Resolution

Nishti’s Choice Ltd is not currently a member of an Alternative Dispute Resolution (ADR) scheme. However, if you are an EU or UK consumer, you may have the right to refer unresolved disputes to the European Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr. Your statutory rights are not affected.

19. Governing Law & Jurisdiction

These Terms are governed by the laws of England & Wales. We prefer that any disputes arising in connection with these Terms or the Membership be subject to the jurisdiction of the courts of England & Wales.

However, if you are a consumer located outside the United Kingdom, nothing in these Terms prevents you from bringing a claim in the courts of your country of residence where mandatory local laws give you the right to do so. Your statutory consumer rights under applicable local law are not affected by this clause.

20. Severability

If any provision or part-provision of these Terms is or becomes invalid, illegal, or unenforceable in any jurisdiction, it shall be deemed modified to the minimum extent necessary to make it valid, legal, and enforceable. If such modification is not possible, the relevant provision or part-provision shall be deemed deleted. Any such modification or deletion shall not affect the validity and enforceability of the rest of these Terms. Where a provision is unenforceable in a particular jurisdiction due to local mandatory law, it shall be severed only in that jurisdiction and shall remain in force elsewhere.

21. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Nishti’s Choice Ltd in respect of the Membership and supersede all prior agreements, representations, and understandings. Should there be any conflict between these Terms and any membership hosting platform or payment gateway, these Terms shall prevail.
